We at San Diego Art Camp do our very best to provide a safe art making environment. In consideration for the privilege of participating in this program, I hereby release and hold harmless San Diego Art Camp for any injuries during class time. San Diego Art Camp is not responsible for children after or before the stated class times. Please type "I understand" in this box.

I understand and agree to the following: Upon enrolling in a class with the San Diego Art Camp (SDAC), an agreed upon class fee will be required by check or credit card. This money amount will be deposited to the SDAC Treasury. 1. In the event of a cancellation of the scheduled event by the student, a credit for a future camp will be given. No refund. 2. In the event #1option is impossible, the student is entitled to full refund of this fee two weeks or more prior to the date of the scheduled class. 3. In the event a cancellation occurs by the student less than two weeks prior to the scheduled class date, the full amount of the deposit is non-refundable. 4. In the event the class is cancelled by SDAC, the student is entitled to a full refund.

In consideration for permitting the Student named below to participate in the San Diego Art Camp at House of Czech and Slovak Republic the undersigned, parent(s) or legal guardian(s) (“Parents”) of Student, on behalf of their heirs, executors, administrators and assigns, and on behalf of Student, hereby agree to the following terms and conditions. 1. Voluntary Participation: Parents give their consent and permission for Student to participate in San Diego Art Camp organized by House of Czech and Slovak Republic in Balboa Park. 2. Description of San Diego Art Camp: San Diego Art Camp may include, but is not limited to the following activities: drawing and painting; making ceramics; learning photography by taking pictures, using cameras iPads, computers and other technologies; dancing and exercising; singing; walking at Balboa Park, visiting museums, playing at children's playgrounds located within Balboa Park, riding Park tram. 3. Acknowledgement and Assumption of Risks: Participation by Student in San Diego Art Camp may be dangerous and carries with it certain inherent risks, including risks that may or may not be obvious, that cannot reasonably be eliminated regardless of the care taken to avoid injuries. The specific risks may range from minor injuries, to major injuries, catastrophic injuries, including permanent disability and death. Parents understand and agree that it is important to follow instructors’ instructions regarding each specific activity. Parents acknowledge that, even if Student follows all directions, instructions, and rules, there will remain a certain irreducible inherent risk to the activity, and Parents accept that risk. Parents have read and understand the above physical and emotional injury risk warnings and, on behalf of themselves and the Student, Parents agree to assume any and all risks of physical or emotional injury and any results from such injuries. 4. Acknowledgement and Assumption of Risks Associated With Exposure to COVID-19. Parents understand that the novel coronavirus, COVID-19, is a highly infectious, life-threatening disease declared by the World Health Organization to be a global pandemic. There is no current medication for COVID-19 or its related illnesses (“COVID-19”). COVID-19 is associated with a serious and potentially deadly condition called Multisystem Inflammatory Syndrome in Children (MIS-C). COVID-19’s highly contagious nature means that exposure to others or contact with surfaces that have been exposed to the virus can lead to infection. Individuals who have COVID-19 may not show any symptoms, even if they are contagious. It is currently exceedingly difficult to control the spread of COVID-19 or to determine whether, where, or how a specific individual may have been exposed to the disease. Parents understand that San Diego Art Camp has implemented safety rules and precautions in order to mitigate the spread of COVID-19. However, those measures do not completely protect against the spread of COVID-19. Moreover, it may not be possible for students, including Student, to follow social distancing and other precautions, such as maintaining a six-foot distance from one another at all times. Parents agree that Parents and Student must comply with such rules and precautions which will include, but are not limited to, mask wearing, hand washing, hand sanitizing, and social distancing. Parents understand that if Parents or Student fails to comply with these rules and precautions, Student could be subject to discipline up to and including revoking permission for Student to participate in San Diego Art Camp. Parents understand these rules and precautions may need to be adjusted throughout the course of San Diego Art Camp, as information about COVID-19 evolves. Parents acknowledge that even if Student and Parents follow all directions, instructions, and rules and exercise utmost personal care, there will remain a certain irreducible inherent risk to Parents and Student, and Parents accept that risk. Parents agree that if Student is exhibiting symptoms of respiratory illness, a fever of 100.4ºF or higher, or any other known symptoms of COVID-19, Student will not attend or participate in San Diego Art Camp until Student has satisfied the San Diego Art Camp policy to return to camp after exhibiting symptoms of COVID-19. Parents agree that they will immediately inform San Diego Art Camp if Student tests positive for COVID-19 or has been exposed to anyone who has tested positive for COVID-19 in the prior 14 days. Parents understand and acknowledge that given the unknown and evolving nature of COVID-19, it is not possible to fully list each and every individual risk of contracting COVID-19. Parents understand that the risk of becoming exposed to or infected by COVID-19 at San Diego Art Camp or as a result of participating in San Diego Art Camp may result from the actions, omissions, or negligence of ParentsStudent, and others, including, but not limited to, San Diego Art Camp employees, agents, volunteers, and students. Parents voluntarily assume full responsibility for themselves and Student for any and all risks of illness, injury, disability, or death associated with exposure to COVID-19, as well as from use of any protective equipment, including but not limited to face masks that San Diego Art Camp may voluntarily provide. 5. Student Conduct: Parents understand and acknowledge that Student is expected to abide by all of San Diego Art Camp rules. Parents agree that San Diego Art Camp has the right, in its sole and absolute discretion, to terminate Student’s participation in San Diego Art Camp at any time for conduct deemed detrimental to San Diego Art Camp to Student, or to other students or teachers. 6. Indemnification/Hold Harmless: Parents may be held liable and responsible for any injury or death to another person or injury to the property of another caused by Student. Parents agree to defend, indemnify (meaning to defend, and to satisfy by payment or reimbursement, including costs and attorneys’ fees) and hold the San Diego Art camp harmless for any claims, actions, costs, expenses, damages, judgments, and liabilities caused in whole or part by the Student’s conduct while attending San Diego Art Camp. 7. Medical Insurance: Parents understand and acknowledge that San Diego Art Camp does not carry or maintain health, medical or disability insurance coverage for Student and therefore agree to assume the responsibility for such insurance coverage on Student for anything that occurs during the San Diego Art Camp. 8. Voluntary Release of All Claims: Parents, on behalf of themselves and Student, voluntarily release, discharge, waive and relinquish San Diego Art Camp, its employees, officers, and teachers (collectively “the Released Parties”), from any and all claims, damages and liability, for any acts, omissions or other occurrences that transpire during, are in any way related to, or arise from Student’s participation in San Diego Art Camp, including but not limited to claims for personal injury, emotional distress, property damage or wrongful death occurring to the Student, and claims for personal injury, disability, illness, damage or death from exposure to COVID-19, whether such exposure occurs during or after Student’s participation in San Diego Art Camp. This release, discharge, waiver, and relinquishment also pertains to any instruction or supervision related to San Diego Art Camp on the part of San Diego Art Camp and the Released Parties. This release extends to any loss, damage or injury resulting from, caused by, or contributed to by the Released Parties, except to the extent caused by the gross negligence or intentional misconduct of the Released Parties. It is the intent of this Agreement to relieve the Released Parties to the greatest extent permitted by law. 9. Voluntary Agreement: Parents’ signature below indicates that they have read and freely signed this Agreement. Parents further certify that they are legally competent to sign this Agreement. And fully understand its terms. Parents understand that their signature below authorizes the Student to participate in San Diego Art Camp, subject to the terms and conditions stated in this Agreement. Unless one parent has had his/her parental rights terminated by court order, both living parents must sign this Agreement.
